Today, FAH jointly submitted with the American Hospital Association, America’s Essential Hospitals, and Association of American Medical Colleges an amicus brief to the DC Circuit Court of Appeals in support of the Battle Creek Health System legal challenge to allow hospitals to seek immediate review of any final CMS determination (under the Administrative Procedure Act) that reduces the payment amounts they receive—including the disproportionate share hospital (DSH) adjustment.
